FUNCTION AND MISSON
DEPARTMENT OF SCIENCE AND TECHNOLOGY
Pursuant to the Decision No. 21/2021/QD-UBND dated July 29, 2021 of the People's Committee of Dak Lak province on defining the functions, tasks and powers of the Department of Science and Technology of Dak Lak province.
1. Location and function
1) Department of Science and Technology of Dak Lak province (hereinafter referred to as Department) is a specialized agency under the provincial People's Committee, performing the function of advising and assisting the Provincial People's Committee in state management of science and technology. science and technology, including: scientific research activities, technological development, innovation; develop scientific and technological potentials; standards, measurement, quality; Intellectual Property; radiation and radioisotope applications; radiation and nuclear safety; manage and organize the implementation of public non-business services in the fields within the scope of functions of the Department according to the provisions of law.
2) The Department of Science and Technology has legal status, its own seal and account as prescribed by law; abide by the direction and management of the organization and operation of the Provincial People's Committee according to its competence, and at the same time comply with the direction, inspection and professional guidance of the Ministry of Science and Technology of the Ministry of Science and Technology. .
2. Duties and powers
1. Submit to the Provincial People's Committee:
a) Draft decisions related to the fields of science, technology and innovation under its management and other documents as assigned by the provincial People's Committee;
b) Draft development plan in the fields of science, technology and innovation; draft programs, schemes, projects, measures to organize the performance of tasks in the fields of science, technology and innovation in the province under its management;
c) The draft decision on decentralization and authorization of state management tasks in the fields of science, technology and innovation to the Department, the district-level People's Committee;
d) The draft decision specifying the functions, tasks, powers and organizational structure of the Department; the draft decision stipulating the functions, tasks, powers and organizational structure of the Sub-department and public non-business units under the Department; draft decision on establishment and regulations on organization and operation of the local Science and Technology Development Fund in accordance with law;
dd) Draft decision on socialization of public non-business service provision activities in the field of science and technology under the authority of the provincial People's Committee and according to the decentralization of superior state agencies.
2. Submit to the Chairman of the Provincial People's Committee: Draft documents under the promulgation competence of the Chairman of the Provincial People's Committee as assigned.
3. Guide, inspect and organize the implementation of legal documents, plannings, plans, schemes, projects, mechanisms and policies on science, technology and innovation after being promulgated. implementation, approval; to inform, propagate, guide, disseminate, educate and monitor the implementation of local laws on science and technology; guide Departments, departments, branches, district-level People's Committees, local science and technology organizations on science and technology management.
4. Manage, register, grant, adjust, revoke and extend permits, certificates, registration papers, diplomas and certificates within the scope of assigned functions and tasks in accordance with regulations of law. by law, as assigned, decentralized or authorized by the People's Committee, the Chairman of the Provincial People's Committee.
5. To make plans and propose estimates of development investment and non-business expenditures on science and technology from the annual state budget for the local science, technology and innovation fields. on the basis of summarizing the estimates of the Departments, departments, branches, district-level People's Committees and related agencies. Monitor and examine the use of state budget for the fields of science, technology and innovation of the province in accordance with the provisions of the Law on State Budget and the Law on Science and Technology.
6. Regarding the management of scientific research, technological development and innovation activities:
a) Organizing the identification, ordering, selection, direct delivery, evaluation, acceptance of scientific and technological tasks; organize the assignment of ownership and right to use results of scientific research and technological development using the state budget;
b) Monitor, examine and evaluate the implementation process and post-acceptance test of science and technology tasks funded with the state budget;
c) Receive, organize the application, evaluate the effectiveness of application of results of scientific and technological tasks proposed by the Provincial People's Committee or order after being evaluated and accepted;
d) Organize the assessment and appraisal of results of performing scientific and technological tasks without using the state budget of organizations and individuals in the province according to the provisions of law;
dd) Coordinating with local departments, agencies and relevant agencies to propose a list of science and technology tasks funded by the national state budget with inter-sectoral and inter-regional nature. socio-economic development of the locality;
e) Establish science and technology advisory councils according to the provisions of the Law on Science and Technology and as decentralized or authorized by the People's Committee, the Chairman of the Provincial People's Committee;
g) Guide and organize the implementation of innovative activities, start-ups and start-ups; exploit and apply technology, commercialize results of scientific research and technological development, propagate results of scientific research, develop technology and innovate; mobilize investment resources for scientific research and technology development, innovation, start-up and innovation in the locality;
h) Supporting organizations and individuals to innovate technology, commercialize results of scientific research and technological development, search for technology, import technology, exploit inventions, decipher and master technology; turmeric; give opinions on technology for investment projects; assess technological capacity and formulate technology development orientations according to the provisions of law.
7. Regarding the development of science and technology markets, science and technology enterprises, science and technology organizations and scientific and technological potentials:
a) Organize survey, investigation and assessment of technological level and capacity of enterprises and science and technology organizations; operational capacity of the intermediary organization of the science and technology market; guiding the establishment and development; certify and inspect the operation of science and technology enterprises, science and technology organizations in the province; synthesize and report to the Ministry of Science and Technology according to regulations;
b) Guide and organize the implementation of mechanisms and policies to encourage and develop technology incubation and science and technology business incubation in the province; formulating and organizing the implementation of solutions to support technological innovation; commercialize the results of scientific research and technological development, develop the science and technology market, and organize the intermediary of the science and technology market;
c) Organize the registration and inspection of activities of science and technology organizations, representative offices and branches of science and technology organizations;
d) Guiding the implementation of the autonomy mechanism by public science and technology organizations in accordance with law; manage the activities of domestic and non-public science and technology organizations under its management;
dd) Guide and manage technology transfer activities in the province, including: technology transfer, technology assessment and assessment, technology transfer brokerage and consulting; appraise or give opinions on scientific and technological bases of investment projects, master plans, socio-economic development programs and other programs and projects of the province according to their competence;
e) Proposing investment projects to develop scientific and technological potentials in the locality according to their competence and organize the implementation after being approved by competent authorities;
g) Organize the implementation of mechanisms and policies on using and honoring individuals for scientific and technological activities; training and fostering local scientific and technological human resources.
8. Organizing research and application of scientific - technical and technological advances; exploiting, commercializing, publishing and propagating results of scientific research, scientific research and technological development, innovation and other scientific and technological activities; coordinate in the implementation of national science and technology tasks using the local state budget.
9. Regarding intellectual property:
a) Organize the implementation of the Intellectual Property Strategy to 2030, tasks and programs in the field of intellectual property within the scope of their assigned competence; take measures to support the development of industrial property activities; industrial property professional guidance for organizations and individuals; manage, build and develop trademarks using place names and other signs indicating the geographical origin of local products; manage geographical indications when authorized;
b) Guide and support organizations and individuals to carry out industrial property procedures; assume the prime responsibility for, and coordinate with relevant agencies in, protecting industrial property rights and handling violations of the law on industrial property;
c) Preside over the implementation of measures to popularize, encourage and promote inventions, initiatives and innovations in the locality; organize the consideration and approval of the recognition of initiatives created by the State's investment in funds, material and technical means in accordance with the provisions of law;
d) Issue, re-issue and revoke the Certificate of industrial property assessment organization according to the provisions of law;
dd) Assist the Provincial People's Committee in performing the state management of intellectual property in related fields according to the provisions of law and decentralization or authorization of the Provincial People's Committee.
10. Regarding standards, measurement and quality:
a) Organize the elaboration and participate in the elaboration of local technical regulations;
b) Organize the dissemination and application of national technical regulations, local technical regulations, national standards, international standards, regional standards, foreign standards, application of conformity assessment methods; conformity with standards and technical regulations; guide the establishment of basic standards for organizations and individuals in the province; inspect and examine the observance of the law on standards and technical regulations in the province; organize the survey of product and goods quality in the locality; warn about the risk of unsafe products for consumers and local authorities;
c) Organize, manage and guide production and business organizations and individuals to announce standards applicable to products, goods, services, processes and environment as assigned. , decentralization of competent state agencies;
d) Receive standard conformity announcements from organizations and individuals registering production and business activities in the locality; receive the declaration of conformity with products and goods that are likely to cause unsafety (group 2 goods) under their management; receive the registration for state inspection of the quality of imported goods in the assigned field; consultation on registration of barcode numbers as assigned or decentralized by competent state agencies; perform the state management of product and goods traceability in the locality;
dd) Carry out the task of informing and answering questions about standards, measurement, quality and technical barriers in trade (hereinafter referred to as TBT) in the province; coordinate with the National TBT Point in handling inquiries and inquiries, reviewing documents and draft TBT measures of the locality and popularizing TBT for businesses to support local exports;
e) To act as the focal point for implementing tasks and programs in the fields of standards, measurement and quality within the scope of local authority; organize a network of inspection, calibration and testing on metrology to meet local requirements; organize the inspection, calibration and testing of metrology in the registered and designated fields and scopes;
g) Receipt of the publication, the adjustment of the content of the publication using the quantitative mark; announcing the use of quantification marks and adjusting the contents of the announcement using quantification marks on prepackaged goods labels in accordance with law;
h) Organize metrological inspection of metrological standards, measuring instruments, measurements, prepackaged goods, metrological inspection, calibration and testing activities in accordance with law; organize the implementation of measures for persons with related rights and obligations to supervise and inspect the performance of measurements, measurement methods, measuring instruments, measurement standards and goods quality; organize the implementation of the establishment, maintenance, preservation and use of local measurement standards;
i) Organize the testing to serve the requirements of state management and the needs of organizations and individuals regarding the quality of products and goods in the province;
k) Assume the prime responsibility for, and coordinate with relevant agencies in, organizing the inspection of the quality of products and goods in production, imported goods, goods circulating in the locality, and goods labels and codes. , barcodes as assigned, decentralized or authorized by competent authorities;
l) Organize the application of the quality management system according to the national standard TCVN ISO 9001 to the operation of agencies and organizations under the local state administrative system in accordance with the law;
m) Guiding organizations and enterprises to participate in national and international quality awards; consider and evaluate organizations and enterprises participating in national quality awards in the province according to regulations;
n) Organize the performance of tasks related to activities to improve productivity and quality of products and goods; acting as the focal point for implementing tasks under the national program to support enterprises to improve productivity and quality of products and goods, the project on product and goods traceability in the locality;
o) Propagating, disseminating and guiding legal documents on standards, measurement and quality to organizations, individuals and enterprises under their management.
11. Regarding the application and assurance of radiation and nuclear safety:
a) Organize the implementation of master plans, plans, programs, projects and measures to promote the application of radiation and radioisotopes for socio-economic development;
b) Manage environmental radiation monitoring activities in the province; coordinate in the management of atomic energy development and application activities according to regulations;
c) Manage public service activities in the field of atomic energy, radiation and nuclear safety in the locality;
d) Manage and implement the receipt and declaration of X-ray equipment for medical diagnostics, and radiation safety assessment. Granting, amending, supplementing, extending and re-granting licenses to conduct radiation work using diagnostic X-ray equipment in medical care; grant certificates of radiation staff to persons in charge of safety at medical diagnostic X-ray establishments operating in the province according to the decentralization of the Provincial People's Committee;
dd) To assume the prime responsibility for, and coordinate with relevant agencies in, inspecting and inspecting the compliance with legal regulations on radiation and nuclear safety in the area under their management and handling violations according to regulations. authorization;

g) Assume the prime responsibility for and coordinate with functional units of the Ministry of Science and Technology in collecting radioactive wastes and radioactive sources detected in the province under management but the owners cannot be identified; coordinate with functional units of the Ministry of Science and Technology in the appraisal, licensing and management of radioactive sources in the province according to the provisions of law;
h) Instructing organizations and individuals in the province to manage measures to manage radioactive waste and used radioactive sources, and to take measures to ensure safety and security when detecting radioactive sources. radiation, nuclear material, nuclear device out of control;
i) Build a local database on radiation and nuclear safety and security control and integrate it with the national database on science and technology.
12. Regarding scientific, technological and innovative information and statistics:
a) Organize and perform processing, analysis, synthesis and provision of scientific and technological information, scientific and technological statistical information and innovation for leadership, management and research purposes. , training, production, business and socio-economic development in the locality;
b) Organize, guide and implement the collection, registration, storage and publication of information on scientific and technological tasks within the scope of local management according to regulations;
c) Building and developing science and technology information infrastructure; participate in building, updating and exploiting the National Database on Science and Technology; building, managing, connecting and sharing local science and technology databases to ensure the integration, exchange and sharing of synchronous and unified data; participate in exploiting, maintaining and developing the Vietnam Research and Training Network (VinaREN) and other scientific and technological information networks; application of information and communication technologies and advanced technical means in scientific and technological information and statistics;
d) The focal point to connect and deploy projects of the Vietnamese Digitalized Knowledge System in the locality. Deploying and building local data projects; develop and integrate local management information and data systems in fields such as education, agriculture, health, science and technology, culture... and share them publicly on the system. digitized Vietnamese knowledge for the community to exploit and use;
dd) Direct the implementation of the local statistical reporting regime on science and technology branches;
13. Regarding public non-business services:
a) Guide non-business organizations in performing public non-business services in the field of science and technology in the province;
b) Organize the implementation of processes, procedures, economic - technical norms for the provision of public administrative services in the field of science and technology;
c) Guide and create conditions to support organizations performing public non-business services in science and technology in accordance with law.
14. Manage, encourage and support the development of enterprises, cooperatives, collective economy, and private economy in the field of science and technology operating in the province.
15. To carry out international cooperation in science and technology according to the provisions of law and as assigned, decentralized or authorized by the provincial People's Committee and superior state agencies.
16. Carry out inspection, examination and settlement of complaints and denunciations in the field of science and technology in accordance with law and as assigned, decentralized or authorized by the Provincial People's Committee. ; organize citizen receptions and implement regulations on anti-corruption and anti-corruption, regulations on thrift practice and anti-waste; handle according to their competence or propose competent agencies to handle violations of the law in the field of science and technology according to the provisions of law.
17. Specifying the functions, tasks and powers of the specialized and professional divisions, offices and inspectors under the Department and the specialized and professional divisions under the Sub-department, non-business units under the Department under the guidance of the Ministry of Science and Technology and regulations of the Provincial People's Committee.
18. Management of organizational structure, civil servant payroll, structure of civil servant ranks, employment positions, structure of public employees according to professional titles and the number of people working in public non-business units under their management. 21. To carry out the work of periodically and irregularly reporting information and reports on the performance of assigned tasks to the Provincial People's Committee, the Ministry of Science and Technology.
22. Perform other tasks assigned by the Provincial People's Committee, the President of the Provincial People's Committee and according to the provisions of law.
3. Organizational structure and staffing
1. Department leaders:
a) Department of Science and Technology has a Director and no more than 03 Deputy Directors. Criteria for titles of Director, Deputy Director of the Department according to the guidance of the Ministry of Science and Technology;

3. Payroll:
The civil servant payrolls, the number of people working for the Department are assigned by the Provincial People's Committee on the basis of job positions, assigned to the functions, tasks, scope of activities of the Department and in the total number of civil servants payrolls, number of people working in provincial agencies and units assigned by competent authorities.
The Director of the Department of Science and Technology is responsible for arranging and employing civil servants, public employees and employees to work in non-business organizations and units under the Department in accordance with law.
